Oak Brook residents refile for school district change

OAK BROOK — A group of Oak Brook residents have refiled their petition to leave their school districts and annex to Butler Elementary District 53 and Hinsdale High School District 86.
Residents of the Midwest Chase subdivision are looking to leave Downers Grove Elementary District 58 and High School District 99. Midwest Chase is a subdivision of 44 single-family homes located north of 35th Street and east of Meyers Road.
The refiling Monday follows a ruling by the Regional Board of School Trustees of DuPage County at a Sept. 27 hearing. That ruling denied a request from the Midwest Chase residents to exclude board member Joseph Wozniak from participating in future proceedings.
Midwest Chase residents also withdrew their previously approved petition to have their request for detachment/annexation heard. A 3-3 vote on that request at an Aug. 20 hearing was good enough to allow for the process to continue.
Wozniak was absent from the Aug. 20 hearing, and districts 58 and 99 had asked for a revote at the Sept. 27 hearing, with Wozniak in attendance.
Jim Pehta, a Midwest Chase resident, said residents wanted to head off a revote after learning Wozniak may have told attornies for district 59 and 99 that he would vote against the petition.
Pehta said if the request of the residents had been rejected during a Sept. 27 revote, they would have had to wait at least two years to try again.
Christopher Stull, an attorney representing Midwest Chase residents, said the new petition has less evidence included, as was the request of the regional board. Stull said he doesn’t expect any response to the new petition until January 2013.
Pehta said the Midwest Chase residents plan to file a lawsuit requesting the detachment and annexation if their petition is rejected.~.
